Keep Complete Deal Jackets and Have the Jackets Available

The CE will inspect 5 or more random deal jackets. Dealer must have the requested files accessible. When it comes to documents, when in doubt, put it in the deal jacket. It’s always better to have too much then not enough. 

Dealers are required to have the following for each motor vehicle, recreational vehicle or mobile home in their inventory:
  1. Indicia of Ownership, A Manufacturers Statement of Origin for new vehicles, or a properly reassigned Certificate of Title for each used vehicle that is being offered for sale or have other approved proof of ownership.
  2. If the title is branded, was the brand disclosed to the purchaser; The vehicle description, identification number or engine number, maker’s number, if any, chassis number, if any, and such other numbers or identification marks as may be thereon, and will also include a statement that a number has been obliterated, defaced, or changed, if such is the fact.
  3. Properly completed odometer disclosure statement. The dealer must maintain copies of odometer statements for five (5) years. Section 319.225(4), F.S., exempt vehicles with GVW more than 16,000, and 10 years old or older, or not self-propelled;
  4. Buyers Guide (As-Is) pursuant to Florida Statutes 320.257(7), 320.27(9)(b)(4) and 320.27(9)(b)(17) and Rule 15C-7, Florida Administrative Code.
  5. A sales contract;
  6. A purchase agreement;
  7. Proof of insurance;
  8. A finance contract;
  9. An insurance contract;
  10. A warranty agreement;
  11. Buyer’s guide;
  12. Temporary Tag log of preprinted stock. Dealer must not issue more than two
  13. temporary tags to the same person for the same vehicle;
  14. Copy of certification of pollution control devices or systems; and
  15. Any other agreement relevant to the motor vehicle transaction.
  16. Proof of lien payoffs;
  17. Proof that the trade-in vehicles were sold after the deal was consummated.
Scrupulous maintenance of records will ensure the dealer passes the records inspection and avoid Administrative Actions against their license.
