The laws of the State makes it necessary for every licensed dealers selling motor vehicles, mobile homes, or recreational vehicles to submit an application for the transfer of title (visit the Department’s website at http://www.hsmv.state.fl.us/html/forms.html to access form HSMV 82040, Application for Title With/Without Registration) or for a duplicate title on behalf of the purchaser. It is illegal for a dealer to hand over the paperwork to a customer and instruct them to apply for transfer of title. That responsibility is solely the dealer’s, who will always be hold responsible by the Division of Motorist Services. (Exceptions see below)

** Note: never erase or use white-out on a Florida Title/out of state title. If corrections need to be done use an affidavit explaining the mistake and the correction made.

Dealers with supplemental locations should include the correct suffix on the application for certificate of title (example: VF-0000000-1) and all other title and registration work to be processed by the tax collector’s office. A dealer is required to apply for a title certificate and registration within 30 days of the date of sale/delivery of the vehicle as mandated per F.S. 319.23(6). In some cases, suspension of a dealer license if the requirement is not met. According to the law of the state, every dealer is expected to submit an application for the transfer of registration and title within 30 days, starting from the day the purchase was made. The 30 days can also be counted from the day the vehicles are delivered to the buyer.
