Another exception to the insurance requirement exists when the vehicle purchased from a dealer is not to be driven from the lot or is unable to be driven from the lot. In this case, the dealer can apply for a “title only” without registering the vehicle. The customer must complete a non-use affidavit. This form is not to be completed by the dealer because it is the customer’s assertion that the vehicle will not be operated in the streets/roads. The dealer will not be responsible if the customer is caught driving the vehicle without a current registration. The dealer is, however, responsible in ensuring that customers who sign a non-use affidavit do not drive the vehicle off the lot. In this case, both the dealer and the customer are guilty of fraud. It is recommended that the dealer maintain documentation regarding the method of transport for such vehicles.
